Abstract
This paper will introduce the putative spouse doctrine as it existed in Texas from the very first case in 1846, discuss the doctrine as it presently stands, and clarify the doctrine's application in future cases. Part II of this article introduces the doctrine and discusses its historical development. Part III addresses the current doctrine and its application to various situations, such as divorce and probate. Part IV compares Texas's treatment of putative spouses with the treatment accorded such spouses in the other community property states. Part V concludes and suggests expansion and codification of the doctrine.
